Marketplace Buyer Terms

    1. Scope

    These Marketplace Buyer Terms ("Buyer Terms") apply when you purchase items on the Citadel TCG marketplace. They supplement the general Terms of Service. By placing an order on the marketplace, you agree to these Buyer Terms.

    2. The Platform's Role

    Castellum - Forge s.r.o. acts solely as an intermediary platform. We provide the technical infrastructure for buyers and sellers to connect and transact. We are not a party to the contract of sale between you and the seller. The contract of sale is formed directly between you and the seller when you place an order and the seller confirms it.

    We do not own, inspect, verify the authenticity of, or guarantee the quality of items listed on the marketplace. While we require sellers to provide accurate descriptions and prohibit counterfeit items, we cannot guarantee compliance by all sellers.

    3. Seller Types and Your Rights

    Each listing on the marketplace clearly indicates whether the seller is a Professional Seller (business) or a Private Seller (individual). This distinction is important because different consumer protection rights apply:

    3.1 Purchasing from Professional Sellers

    When you buy from a professional seller (a business or trader), you are protected by EU consumer protection laws, including:

    • Right of withdrawal: 14-day cooling-off period (see Section 7)
    • Legal guarantee of conformity: 2-year guarantee (1 year for used goods in some jurisdictions) — the item must match the description and be of satisfactory quality
    • Pre-contractual information: The seller must provide their identity, address, and the main characteristics of the goods before purchase

    3.2 Purchasing from Private Sellers

    When you buy from a private individual (a person who is not acting as a business), EU consumer protection laws, including the right of withdrawal and the legal guarantee, generally do not apply. The transaction is a private sale between two individuals. You should exercise appropriate caution, including reviewing the seller's rating and reviews.

    4. Placing Orders

    When you place an order:

    • You confirm that you intend to purchase the item(s) at the displayed price, including any shipping costs
    • The order constitutes a binding offer to the seller
    • The contract is formed when the seller confirms and ships the order
    • All prices shown include applicable taxes where the seller is a professional

    5. Payment

    Payments are processed securely through Stripe. By completing a purchase, you authorize Stripe to charge your payment method for the total order amount (item price + shipping costs + any applicable taxes).

    The Platform charges the seller a service commission (1.5% by default) plus payment-processing costs that recover our payment provider's fees (approximately 1.5% + €0.25 per transaction). These are deducted from the seller's payout and do not add to the price you see.

    6. Shipping and Delivery

    • Shipping methods, costs, and estimated delivery times are set by the seller and displayed at checkout
    • The seller is responsible for shipping the item to you
    • Shipping costs and delivery estimates are also included in the invoice
    • If the seller provides tracking information, it will be available in your order details
    • Unless otherwise agreed, professional sellers must deliver goods within 30 days from the date of the order (per Article 18 of Directive 2011/83/EU)

    7. Right of Withdrawal (14-Day Cooling-Off Period)

    Applies only to purchases from Professional Sellers.

    If you are a consumer in the European Union or the United Kingdom, you have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.

    7.1 How to Withdraw

    To exercise your right of withdrawal, you must inform the seller of your decision by a clear statement. You may use the withdrawal form below, but it is not mandatory. You can also contact the seller directly through the platform.

    7.2 Effects of Withdrawal

    • The seller must reimburse all payments received from you, including standard delivery costs, within 14 days of being informed of your withdrawal
    • The seller may withhold the refund until they receive the returned goods or you provide proof of return shipping
    • You must return the goods to the seller without undue delay and in any event within 14 days of informing the seller of your withdrawal
    • Return shipping costs are borne as specified in the seller's return policy (displayed at checkout)

    7.3 Exceptions

    The right of withdrawal does not apply to:

    • Sealed goods that were unsealed after delivery and are not suitable for return due to protection reasons (this may apply to factory-sealed booster packs and similar products)
    • Goods that have been inseparably mixed with other items after delivery
    • Purchases from private sellers (see Section 3.2)

    7.4 Model Withdrawal Form

    8. Warranty and Conformity

    Purchases from Professional Sellers:

    • The seller is legally obligated to deliver goods that conform to the contract
    • The legal guarantee of conformity is 2 years from delivery (in Slovakia, this may be reduced to 1 year for used goods with the consumer's agreement)
    • If goods are defective or do not match the description, you may request: repair, replacement, a price reduction, or a full refund (depending on the severity)
    • Within the first year, defects are presumed to have existed at the time of delivery (the seller must prove otherwise)

    Purchases from Private Sellers:

    • No legal guarantee of conformity applies
    • Items are sold "as described" — the seller must not misrepresent the condition or characteristics
    • Disputes are resolved between you and the seller, with platform support for communication

    9. Disputes and Returns

    9.1 Contacting the Seller

    If you have an issue with a purchase, we encourage you to first contact the seller directly through the platform's messaging system.

    9.2 Opening a Dispute

    If you cannot resolve the issue directly with the seller, you may open a formal dispute through the platform on orders with status "Paid", "Shipped", or "Delivered". When opening a dispute, you must provide a clear description of the issue.

    9.3 Refunds

    • Before shipment: You may cancel the order and receive a full refund.
    • After shipment: The order can no longer be cancelled. If the order does not arrive, you may report it in the app on the order details page using "Order did not arrive" — available from 14 days after shipping for tracked shipments, 30 days for untracked shipments.
    • After delivery: Refunds are available through the dispute process or by exercising your right of withdrawal (professional sellers only).

    Paid orders that have not shipped within 7 days of payment may be cancelled directly by the buyer through the app.

    Delivery problems must be reported through the in-app "Order did not arrive" process before initiating any payment dispute with your card issuer.

    Refunds are processed through Stripe to your original payment method. Processing time depends on your payment provider.

    10. Alternative Dispute Resolution

    If a dispute with a seller cannot be resolved through our platform, consumers in the EU may submit the dispute to an authorized Alternative Dispute Resolution (ADR) entity.

    The EU Online Dispute Resolution (ODR) platform was discontinued on July 20, 2025 pursuant to Regulation (EU) 2025/40.

    11. Reviews and Ratings

    After a completed purchase, you may leave a review and rating for the seller. Reviews must be:

    • Based on your actual purchase experience
    • Truthful and accurate
    • Not defamatory, abusive, or in violation of the Terms of Service

    We do not edit or selectively publish reviews. All reviews from verified purchasers are displayed. We may remove reviews that violate our Terms. Sellers may respond to reviews publicly.

    12. Platform Liability

    As an intermediary, Castellum - Forge s.r.o. is not liable for:

    • The quality, safety, legality, or authenticity of items sold by sellers
    • The accuracy of seller listings or descriptions
    • Seller compliance with shipping timeframes or return policies
    • Any loss or damage arising from a transaction between you and a seller

    We provide tools for communication, dispute resolution, and payment processing to support fair transactions, but the contractual relationship is between you and the seller.

    13. Governing Law

    These Buyer Terms are governed by the laws of the Slovak Republic. If you are a consumer in the EU, this does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence. You may bring proceedings in the courts of your habitual residence.
